On second thought I just remembered hearing that BD actually went and made a Deathclaw toy. Because they think copyright doesn't cover dildos unless it's another dildo design looking similar to one of theirs. Or they probably just don't care.
Bad Dragon made a toy cheekily inspired by a deathclaw yes, no direct reference, just inference. It's not illegal. Unless you're going to claim EE's cyborg is stealing IP from Marvel and the Halfling is stealing IP from New Line Cinema you're not making much of a case there
I don't know any of those products. Fact is, these big companies have shown time and time again that a simple name change does NOT avoid copyright infringement, and in cases like BD's Deathclaw toy and Tauntaun toy that's literally all they've done. Because it's a for-profit product they can't claim parody and win if taken to court over it.
The ONLY reason they haven't been sued to hell and back is the big companies owning the IPs don't feel it makes significant profit, or aren't notably aware, but as we can probably imagine given BD's popularity it's definitely making a good deal of money off of something that isn't theirs.
On top of that, BD has clearly threatened legal action against Frisky Beast behind the scenes for naming a toy "Chimera" despite looking nothing like Apollo, which it's now named The Missing Link. Best part is, "Chimera" is not a copyrightable name due to being invented several centuries ago, it's public domain.
